Terms & Conditions

Welcome to Abounader Fitness. By accessing our website, purchasing services, or entering our facility, you agree to the following Terms & Conditions, as well as the Hold Harmless, Indemnity, and Arbitration Agreement incorporated herein.
1. Membership & Purchase Policy
All purchases made with Abounader Fitness are final.
- No refunds will be issued for memberships, passes, services, or merchandise
- Memberships and passes are non-transferable and non-shareable
- Unauthorized sharing of memberships or access may result in termination without refund
Abounader Fitness reserves the right to modify pricing, memberships, and services at any time.
2. Age Requirements & Minors
- Members must be 18 years or older to access the facility independently
- Individuals under 18 must have:
- Written parental or legal guardian consent
- A signed liability waiver executed by a parent or legal guardian
Parents or guardians acknowledge and agree that they are responsible for the minor’s conduct and safety while on the premises.
3. Assumption of Risk
Use of the facility, equipment, showers, and related amenities involves inherent risks, including but not limited to:
- Serious injury
- Illness
- Death
- Property damage
By entering the facility, you acknowledge that you are voluntarily participating and assume all risks associated with such use, as further detailed in the liability waiver.
4. Health Acknowledgment
- You are physically able to participate in fitness activities
- You are responsible for your own health and safety
- You understand that Abounader Fitness does not provide medical advice
5. Access & Facility Use (Self-Service Model)
Abounader Fitness operates with a self-service model, and staff may not be present at all times.
By entering the facility, you acknowledge:
- You may access the facility during unstaffed periods
- You are responsible for your own safety and use of equipment
- You understand that immediate assistance may not always be available
Access credentials:
- Are for individual use only
- May not be shared, transferred, or duplicated
Violation of access policies may result in termination of access without refund.
6. Facility Rules & Member Conduct
- Wear appropriate attire and footwear
- Use equipment properly
- Return equipment after use
- Maintain cleanliness, including wiping down equipment
Abounader Fitness reserves the right to suspend or terminate access for inappropriate, unsafe, or disruptive behavior.
7. Personal Property
All personal belongings are brought at your own risk.
Abounader Fitness is not responsible for lost, stolen, or damaged items.
8. Media Release
By entering the facility, you acknowledge that photos or videos may be taken for promotional purposes.
If you wish to opt out, please notify management in writing.
9. Hold Harmless, Indemnity, and Arbitration Agreement
PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS
Your use of Abounader Fitness is subject to the Hold Harmless, Indemnity, and Arbitration Agreement that you have executed or will execute prior to using the facility.
That Agreement includes, but is not limited to:
- Assumption of all risks associated with use of the facility
- A full release and waiver of liability, including claims arising from negligence
- Indemnification obligations in favor of Abounader Fitness and related parties
- Agreement to resolve disputes through binding arbitration
- A requirement that claims be brought within sixty (60) days
- Waiver of the right to bring claims in court or have a jury trial
In the event of any inconsistency between these Terms & Conditions and the executed liability waiver, the liability waiver shall control.
10. Governing Law
These Terms & Conditions are governed by the laws of the U.S. Virgin Islands.
11. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. Changes to Terms
Abounader Fitness reserves the right to update these Terms & Conditions at any time. Continued use of the facility or services constitutes acceptance of any updates.
